Fair Use Policy

SymmetriCall is dedicated to providing a safe way for users to make and receive calls, and in order to achieve that goal, we do not permit certain behaviors while using SymmetriCall.

This Fair Use Policy outlines rules for using SymmetriCall's Services and is incorporated in our Terms of Use. Review our Terms of Use for more information.

We may modify this Policy from time to time as set forth in our Terms of Use. Your continued use of SymmetriCall after we have modified this Policy constitutes your acceptance of its terms.

Prohibited Activities

When using SymmetriCall, you and any users affiliated with your account must not use the Service to:

  • Engage in behavior that is unlawful, harmful, abusive, indecent, obscene, threatening, harassing, violent, defamatory, libelous, deceptive, misleading, fraudulent, malicious, indecent, obscene, illicit, or tortious;
  • Exploit or harm minors, or solicit information about minors without parental consent;
  • Place calls or send messages without proper consent, including cold calls or prerecorded campaigns lacking a clear opt-out mechanism;
  • Call during prohibited or “quiet” hours where outreach is generally considered abusive or intrusive;
  • Call numbers in violation of applicable Do Not Call restrictions;
  • Engage in continuous or repetitive calls or messages in a way that does or could reasonably lead to complaints, including continuing to call or message individuals after a complaint has been received or after being asked to stop;
  • Engage in traffic pumping or schemes designed to artificially inflate call volumes to high-cost or revenue-sharing numbers;
  • Generate excessive short-duration calls or abnormal spikes in call attempts;
  • Call or message large numbers of unique or sequential phone numbers in a manner inconsistent with normal business use by humans;
  • Routinely call conference lines, chat lines, or similar services for non-business purposes;
  • Commit fraudulent or deceptive acts, including impersonation, misrepresentation, or other behavior intended to defraud recipients;
  • Send prerecorded voicemails (“voicemail drops”) in a fraudulent or harassing manner;
  • Use SymmetriCall numbers as misleading or fraudulent callback numbers;
  • Spoof or manipulate caller ID information with the intent to deceive, harass, or commit fraud;
  • Leverage bots, auto-dialers, or any automated calling or messaging systems under any circumstances;
  • Collect or gather user data without consent, where required, or otherwise without legal authorization.

Additionally, use of SymmetriCall in an unauthorized, excessive, or other manner that is designed to or could interfere with, compromise, or otherwise disrupt our equipment, networks, accounts, or ability to provide service is prohibited. This includes excessive usage of call minutes, messaging or other capabilities that are not consistent with normal, fair and reasonable use.

Call Recording and Transcription

Certain SymmetriCall Services provide a function that allows you to record individual telephone conversations. The laws regarding the notice, notification, and consent requirements for recording conversations vary from state to state. In some states, you are required to obtain consent from all parties to record a conversation. You are solely responsible for complying with all federal, state, and local laws in any relevant jurisdiction when using this recording feature, including obtaining all proper consents for recording by you or recording by SymmetriCall on your behalf. SymmetriCall expressly disclaims all liability with respect to your recording of telephone conversations. You hereby agree to fully, finally, and forever release, discharge, hold harmless, and fully indemnify SymmetriCall from and against any damages or liabilities of any kind related to your recording of any telephone conversations using the Services.

Similarly, the laws applicable to call transcription differ by state. For some jurisdictions, transcribing recorded calls, recording calls, or even transcribing real-time speech over a call or video is prohibited or requires informed consent by some or all parties to the conversation. You are solely responsible for complying with all federal, state, and local laws in any relevant jurisdiction when using this transcription feature, including obtaining all proper consents for transcription by you or transcription by SymmetriCall on your behalf. SymmetriCall expressly disclaims all liability with respect to your transcription of telephone conversations. You hereby agree to fully, finally, and forever release, discharge, hold harmless, and fully indemnify SymmetriCall from and against any damages or liabilities of any kind related to your transcription of any telephone conversations using the Services.

911 Service

FOR USERS OF SYMMETRICALL, ACCESS TO EMERGENCY SERVICES (911) IS NOT AVAILABLE. BY USING SYMMETRICALL, INCLUDING PORTING YOUR EXISTING NUMBERS TO SYMMETRICALL, YOU ACKNOWLEDGE THAT YOU SHOULD MAKE ALTERNATIVE ARRANGEMENTS TO REACH 911 AND THAT YOU WILL INFORM ALL BUSINESS COLLEAGUES, GUESTS, AND OTHER PERSONS WHO MAY BE PRESENT AT YOUR PHYSICAL LOCATION THAT 911 IS UNAVAILABLE THROUGH SYMMETRICALL.

WE RECOMMEND YOU MAKE ALTERNATIVE ARRANGEMENTS TO PLACE 911 CALLS, SUCH AS USING A TRADITIONAL WIRELINE OR CELLULAR TELEPHONE, AND YOU SHOULD NOT RELY ON SYMMETRICALL TO CALL 911.

YOU UNDERSTAND THAT THE SYMMETRICALL MOBILE APPLICATION USES YOUR DEVICE'S DIALER AND CELLULAR TELEPHONE SERVICE TO MAKE 911 CALLS. IF YOUR DEVICE DOES NOT HAVE CELLULAR TELEPHONE SERVICE, YOU WILL NOT BE ABLE TO CALL 911 FROM THE SYMMETRICALL MOBILE APPLICATION. SYMMETRICALL DISCLAIMS ANY AND ALL LIABILITY RELATING TO YOUR (OR ANY OF YOUR USERS OR THIRD PARTIES) INABILITY TO MAKE 911 CALLS OR ACCESS EMERGENCY SERVICES.

Messaging

Certain SymmetriCall services utilize messaging (SMS) to deliver features. SymmetriCall treats all messaging transmitted via the Service as Application-to-Person (“A2P”) messaging. All A2P messages originating from SymmetriCall are subject to this Messaging Policy. You are responsible for any person to whom you provide the ability to send messages from your account through the Service.

You acknowledge that certain types of content are prohibited from being sent over SMS, and you understand that you are prohibited from sending messages regarding sex, hate, alcohol, firearms and tobacco (SHAFT). These restrictions apply even in jurisdictions where certain activities may be legal under local law.

Consequences for Violation

SymmetriCall reserves the right to take reasonable action at our discretion if we believe you have violated this policy. Reasonable actions include imposing limits and charging overages on your usage, suspending your account or terminating your use.

Whenever reasonably possible, SymmetriCall will give you written notice of your violation of this policy before taking any such action.
